Consumer sales – period of prescription

Consumer enjoy certain preferences regarding the period of prescription for claims. The period of prescription for consumer claims (for repair or replacement) must not expire before the expiry of the seller’s liability (in the case of movable property the seller is liable for defects identified within 2 years after issuing the item to the buyer).


An example: An item was issued to the buyer on January 2, 2015. A defect was identified on January 5, 2015. If the buyer is not a consumer, a claim for repair or replacement must be submitted not later than on January 5, 2016. However, a consumer can make claims until January 2, 2017, i.e. until two years after receiving the item.
