Cost of removal and reinstallation in consumer sales
If the buyer is a consumer, the seller cannot refuse to remove and then reinstall a purchased item (under warranty rights), even if the cost of such works exceeds the price of the item. However, in such a case the consumer is obliged to pay for the cost of removal and reinstallation to the extent it exceeds the price of the purchased item.
An example: An item was purchased for PLN 300. After its installation it turned out that the item is defective. The cost of removal and reinstallation will be PLN 400. The consumer has the right to demand that the seller carries out those works. The seller will have the right to demand from the consumer reimbursement of PLN 100 (value by which the costs exceed the price).
